Terms and Conditions for  www.tyta.nl and the TyTa mobile application

On this page you will find the terms and conditions of ( www.tyta.nl) and the (TyTa mobile application), as made available by (TyTa BV). In these terms and conditions we indicate under what conditions we offer you the information provided on our website and in our mobile application.

General

By visiting the site and using the service of ( www.tyta.nl), and / or downloading, installing or using the (TyTa mobile application) or if you are paying someone to visit the site (www. tyta.nl) and use the service, and / or to download, install, and use the (TyTa mobile application), you agree to the terms and conditions described in this document. If you do not agree with these terms and conditions, neither you nor the person whom you have paid may access the site ( www.tyta.nl), download, install or use the service of the (TyTa mobile application) .

Definition

Student: User of the TyTa mobile application who has registered as a Student and has created a Student profile

Tutor: User of the TyTa mobile application that has registered as Tutor and has created a Tutor profile

Agreement

The agreement that the user enters into with (TyTa BV) involves obligations for both the user and (TyTa BV). By means of the available service, the site ( www.tyta.nl), and the software (TyTa mobile application), we make it possible for you to get in touch with students or tutors and thus enable tutoring work. This contact is established as quickly and effectively as possible by our software. The agreement is effective until cancellation. On the online platform, students who want to tutor students who need tutoring, can use a chat function. Both have the option to send (speech) messages and images through the application. These applications are maintained and supported by (TyTa BV). (TyTa BV) does its utmost best to monitor security on the online platform. In addition, data such as time, content and duration of the sessions are also viewed and assessed on a sample basis. Furthermore, (TyTa BV) handles your personal details with the utmost care and only specially authorized employees have access to the database in which your details are stored. Users do not have access to this database under any circumstances. The user commits to deliver and, if necessary modify, recent, correct and complete data on time. The user also commits to create an account with user name and password, to pay the amount of money due for the session after the end of the session (only applies to a student profile) and agreeing to these terms and conditions. The data that the users provide us, helps us to adapt the service and content of the site ( www.tyta.nl) and the (TyTa mobile application) to the needs of the users. Students and tutors do their best and promise to keep their answers as efficient and focused as possible. (TyTa BV) endeavors to have as many students and tutors as possible available for the various courses and in this way to keep the waiting time as short as possible. (TyTa BV) is not responsible or liable for the absence of a correct tutor. As an online service ( www.tyta.nl) and the (TyTa mobile application) are permitted to be unavailable every now and then as needed to achieve maintenance and improvements. We try to keep the site ( www.tyta.nl) and the (TyTa mobile application) accessible as much as possible. By agreeing to these terms and conditions, you promise to protect the content of the site ( www.tyta.nl), the service and the (TyTa mobile application) and to prevent unauthorized or improper use.

Rates and payment

User owes (TyTa BV) a commission fee of 0%. (TyTa BV) is at all times permitted to change this commission fee. If this commission fee is changed, the user will be informed on time by email and the new commission fee will be included in a renewed version of the Terms and Conditions.

The user is responsible to pay for additional costs such as telephone or cable connections to establish internet access as well as for the maintenance of computer, hardware and accessories and other devices required to access and use the site ( www.tyta.nl) and the (TyTa mobile application).

The base currency used throughout whole TyTa mobile application is EURO (€).

After completing the session using the TyTa mobile application software, the student must proceed immediately to pay the amount of money owed to (TyTa BV). This can be done via iDEAL (handled by payment platform Stripe) or via a credit card payment (handled by payment platform Stripe); after which (TyTa BV) immediately proceeds to make the money from the session available to the tutor (the tutor profile), by increasing the value of the virtual wallet belonging to the profile page of the tutor with the amount of money from the session. From then on the tutor can transfer the money from his virtual wallet to his own bank account at any time. The value of the tutor's virtual wallet is then reduced by the value of the amount of money transferred by the tutor from his virtual wallet to his bank account. The maximum amount of money that the tutor can transfer from his virtual wallet to his bank account is the current total value of the money in the tutor's virtual wallet. The minimum value that can be transferred by the tutor is 1 EUR. After the payment request has been submitted by the tutor, (TyTa BV) has 24 hours to transfer the amount of money to the IBAN bank account entered by the tutor. Please note, it depends on the tutor’s bank when the tutor actually receives the money in his account. We would also like to point out that we only transfer money to IBAN bank account numbers that belong to the countries participating in the SEPA system.

After the session, if the student does not immediately pay the owed amount to (TyTa B.V); (TyTa B.V) has the right to investigate within a period of 5 days after the end of the session, whether there has been payment fraud between the student (the student profile) and the tutor (the tutor profile).

If payment fraud is found between the student (the student profile) and the tutor (the tutor profile), where both profiles are to blame, then (TyTa BV) will not make the amount of money due from the tutoring session available to the tutor ( the tutor profile), (TyTa BV) will therefore not increase the value of the virtual wallet belonging to the profile page of the tutor by the amount of money owed by the tutoring session; and both profiles (student profile and tutor profile) will be blocked.

If one-sided payment fraud is discovered on the part of the student (the student profile) and the tutor (the tutor profile) has not been found to be at fault, (TyTa BV) will proceeded to make available the amount of money due from the tutoring session, by increasing the value of the virtual wallet belonging to the profile page of the tutor with the amount of money due from the session within a maximum of 5 days after the end of the session between the student (the student profile) and the tutor (the tutor profile).

All financial transactions and transactions take place online, in the secure environment offered by payment platform Stripe (iDEAL / Credit card payment).

Safety

When entering into agreement with (TyTa BV), use your email address to log in to ( www.tyta.nl) and/or the (TyTa mobile application). Think of a nonobvious password. You may never allow someone other than yourself to use your account, username or password (s) or give them to a third party and/or sell them. Users do not have access to the database and cannot access any information about other users, other than those entered by the users themselves on the platform. Users must not attempt to access the database.

Privacy

We find the privacy of the users of (TyTa BV) very important. By agreeing to these terms and conditions, you agree to our privacy statement. The number of personal data that we require from you when entering into the agreement is set up to a minimum such that the TyTa mobile application can still function properly. In this way we have no more information in our database than we need. This way your privacy will be guaranteed as much as possible. Personal data is carefully stored. Employees and management of (TyTa BV) who have access to the data in the database guarantee care in handling this data. Everything you upload on the site ( www.tyta.nl) and/or on the (TyTa mobile application), or communicate to us, or communicate to the site or service in any way whatsoever, is considered non-confidential and not your property and can be used by us in any way, such as for quality control and professional development of the site and the promotion of our site. With this we mean all the material, all information, all communication or all your ideas. (TyTa BV) owns all text on the site, including texts that you have added on the site. You agree that we monitor and save additional sessions or parts for quality control and other purposes. The text of all sessions is the property of (TyTa BV) and can be used by us. You give permission for your data to be used for research so that we can optimize our service. Results from research may be provided to third parties. In addition, with data registration you give consent to (TyTa BV) to use your data for communication purposes. Liability

We do not charge the user for the use of the website and mobile application. On the other hand, TyTa BV can adjust its service at any time. TyTa BV cannot guarantee that the website and mobile application are always available. TyTa BV cannot guarantee the educational correctness, completeness and topicality of the information on the website and mobile application. The use of information on the website and mobile application is the responsibility of the user. TyTa BV is not responsible for the content of the (educational) information, but it does try to guarantee the quality of this as well as possible. Agreements established between users are only between users. TyTa BV acts exclusively as a mediator and is not a contracting party to the agreement between the student (student profile) and the tutor (tutor profile). TyTa BV is not liable for the implementation of the agreement between the student (student profile) and the tutor (tutor profile). TyTa BV is not liable for any damage resulting from the aforementioned agreement. TyTa BV makes every effort to check the quality of the tutors to the best of their ability. However, TyTa BV cannot guarantee that the tutor has the correct qualifications. The content of the website and mobile application has been compiled with the greatest care. TyTa BV cannot, however, guarantee that information placed by itself on the website and mobile application is correct and complete at all times. All information on the website and mobile application and in other materials originating from TyTa BV are therefore subject to obvious programming and typing errors. TyTa BV may contain links to third-party websites. TyTa BV does not guarantee the correct operation of these links. TyTa BV has no control over these websites and does not accept any liability that arises after use and/or visit to these websites. Limitations or exclusions of liability as included in the Terms and Conditions do not apply in the event of intent or deliberate recklessness on the part of TyTa BV.



Complaints

Your feedback and complaints will always be taken seriously. You can forward this to us by sending your complaint to (TyTa, Boeroestraat 108, 1095 WB Amsterdam) or info@tyta.nl. All complaints are handled and assessed accordingly. (TyTa BV) will take appropriate action in case the complaint is found to be valid.



Amendments

We reserve the right to change these terms and conditions at any time. If we make substantive changes to our terms and conditions, we will notify you prior to this change via the e-mail or via a message on our website. Any change will take effect immediately upon publication at this location. With your next use of the site ( www.tyta.nl) and/or the (TyTa mobile application) you agree to these changes and / or changes to the conditions. Furthermore, the most current version is posted on the site as soon as possible ( www.tyta.nl). These terms and conditions were last updated on the date indicated below.



Intellectual property

Software, the technology behind our service and all other software, designs, material, communication, text, illustrations, animations, images, photos, audio, video, drawings, images and other information, data and material, including parts and assemblies of this that you delivered or made accessible via or on the site, service or software are the property of (TyTa BV). These are fully and without restrictions protected and may not be used, published, reproduced, depicted, copied, distributed, imitated, broadcast, circulated, mirrored, altered, rented out, sold or otherwise used, neither in the Netherlands nor abroad, without our permission. Unauthorized use will be reported to the police. The use of the information on this website is free as long as you do not copy, distribute or otherwise use or misuse this information. You may only reuse the information on this website in accordance with the rules of mandatory law. Re-using text, photo material or other materials on this website is not permitted without the express written permission of TyTa BV. The intellectual property rests with TyTa BV.

This terms and conditions may be changed by TyTa from time to time if new developments occur and/or it deems this necessary. If TyTa makes substantive changes or is required to do so by law, we will notify you prior to this change through the e-mail or through a message on our website. Read this terms and conditions regularly, especially before you provide us with any personal data. This terms and conditions was last updated on the date indicated below. If you continue to use our application after any changes or revisions to this terms and conditions, your use will indicate your agreement to the terms of this revised document.
